Spotlight Terms of Service

1. Acceptance of these Terms
These Terms of Service ("Terms") are a binding contract between you and Spotlight Recruit LLC ("Spotlight," "we," "us," or "our"), a Florida limited liability company located at 11604 61st St E, Parrish, FL 34219, United States.
These Terms govern your use of the Spotlight mobile application and our website at spotlightrecruit.com (collectively, the "Service").
By creating an account or using the Service, you agree to these Terms. If you do not agree, you may not use the Service.
If you are using the Service on behalf of an organization (such as a recruiting institution), you represent that you have authority to bind that organization to these Terms.
2. About Spotlight
Spotlight is a platform that connects student-athletes seeking opportunities in their sport with verified college and athletic program recruiters. The Service is provided "as-is" and we make no guarantees about results (we cannot guarantee any user will be recruited, scouted, contacted, or offered a position).
3. Eligibility
You may use Spotlight only if:
- You are at least 13 years old
- If you are under 18, your parent or legal guardian has consented to your use of the Service and you provide their email address at signup
- You are legally capable of entering into a binding agreement
- You are not banned, suspended, or otherwise restricted from the Service
- Your use does not violate any applicable laws
We may verify your identity (especially for recruiter accounts) and may refuse service if we cannot verify your information.
4. Account types
Spotlight has two account types:
- Athlete account: for student-athletes seeking to be discovered by recruiters
- Recruiter account: for college coaches, athletic program staff, and other recruiting personnel
You may only hold one account, and you must select one account type at signup. Athletes and recruiters cannot hold both types. Account type cannot be changed after signup.
5. Account responsibilities
You are responsible for:
- Providing accurate and complete information about yourself
- Maintaining the security of your password — never share it with anyone
- All activity that happens on your account
- Notifying us immediately of any unauthorized access (email support@spotlightrecruit.com)
You may not:
- Create more than one account
- Create an account using someone else's name, identity, or information
- Create a fake account
- Sell, transfer, or share your account with anyone else
- Use the Service through an automated bot or scraper
6. Athlete-specific rules
If you have an Athlete account:
- Videos must be of you. All videos you upload must be authentic footage of you playing your sport. Do not upload videos of other people, AI-generated videos of yourself, or videos that misrepresent your skill level or athletic ability.
- Stats must be accurate. If you provide athletic statistics, they must be truthful. Inflating or fabricating statistics is grounds for immediate account termination.
- 30-second clip limit. Each individual video must be 30 seconds or less. We enforce this automatically.
- No personal contact info in clips or bio. Do not include phone numbers, home addresses, school addresses, or other personal contact information in your videos or bio text.
- Age and minor status are locked. Once you create your account, your age and minor status cannot be changed. If you believe there is an error, contact support@spotlightrecruit.com.
7. Recruiter-specific rules
If you have a Recruiter account:
- Verification required. You must be verified by our administrative team before you can browse athlete profiles. This may take 1-3 business days. We may request additional information to confirm your identity and credentials.
- Professional contact only. Communicate with athletes only for legitimate recruiting purposes. Do not solicit personal information, request communications outside legitimate channels, or engage in any inappropriate communication.
- Special rules for contacting minors. When contacting an athlete under 18, you must communicate exclusively through their parent's email address on file. You may not attempt to contact a minor through any other means, including social media, direct messages, or personal contact information that may appear elsewhere.
- Honest representation. You must accurately represent your organization, role, and recruiting authority. Misrepresentation is grounds for immediate suspension.
Any inappropriate contact with a minor — including but not limited to predatory behavior, requests for personal information, sexual or romantic content, requests to meet in person, or any communication designed to circumvent parental oversight — will result in immediate and permanent ban, reporting to law enforcement, and may give rise to civil and criminal liability.
8. Prohibited conduct
You agree NOT to:
- Use the Service for any illegal purpose
- Harass, threaten, stalk, intimidate, or bully any other user
- Impersonate any person or entity, or falsely claim affiliation with any person or organization
- Upload content that is illegal, infringing, hateful, sexually explicit, violent, defamatory, deceptive, or invasive of privacy
- Engage in or attempt to engage in any sexual contact, communication, or solicitation with a minor
- Attempt to circumvent the safety measures we have in place to protect minors
- Distribute spam, advertising, multi-level marketing schemes, or unsolicited messages
- Use the Service to recruit athletes for non-athletic purposes (such as modeling, entertainment unrelated to sports, etc.)
- Scrape, mine, or otherwise extract data from the Service without our written permission
- Reverse-engineer, decompile, or otherwise attempt to derive the source code of the Service
- Bypass any technical restrictions of the Service
- Use the Service in any way that could damage, disable, or impair our infrastructure
- Violate any applicable law or regulation
9. Content and ownership
You retain ownership of content you create and upload (your profile information, videos, photos, etc.).
However, by uploading content to the Service, you grant Spotlight a worldwide, royalty-free, non-exclusive license to host, display, distribute, and reproduce that content as needed to operate the Service. This license terminates when you delete the content or your account, except that:
- Content shared with other users (e.g., athletes' videos viewed by recruiters) may have been retained or screenshot by those users; we have no control over content that has left the Service.
- We may retain anonymized log data for security purposes.
You represent and warrant that:
- You own or have the necessary rights to all content you upload
- Your content does not infringe any third party's rights (copyright, trademark, privacy, publicity, etc.)
- For videos that show other people: those people consent to appearing in your video
- For videos featuring trademarks, music, or other third-party content: you have any necessary licenses
10. DMCA / copyright complaints
If you believe content on the Service infringes your copyright, send a notice to legal@spotlightrecruit.com containing:
- Your contact information
- Identification of the copyrighted work
- The specific URL or location of the allegedly infringing content
- A statement that you have a good faith belief that the use is not authorized
- A statement under penalty of perjury that the information is accurate
- Your signature (physical or electronic)
We will respond to valid DMCA notices in accordance with applicable law.
11. Reporting violations
If you observe content or behavior that violates these Terms:
- Use the in-app reporting feature (when available) to report the user or content
- Email abuse@spotlightrecruit.com with details
We take all reports seriously and will investigate. We may take action including warning, suspending, or permanently banning users who violate these Terms.
12. Suspension and termination
We may suspend or terminate your account at any time, with or without notice, for any reason, including:
- Violation of these Terms
- Failure to verify your identity (for recruiter accounts)
- Inappropriate behavior toward other users (especially minors)
- Fraudulent or deceptive practices
- Behavior that violates applicable law
- Inactivity for an extended period
- For any other reason at our discretion
You may also delete your account at any time from the Settings page in the app. Account deletion is permanent and immediate.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING (BUT NOT LIMITED TO) WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.
We make no warranties about:
- The reliability, accuracy, or completeness of the Service
- Whether the Service will be uninterrupted, secure, or error-free
- Whether any defects will be corrected
- The results that may be obtained through use of the Service
- Whether you will be recruited, scouted, contacted, or offered any opportunity by any recruiter
We do not vet, screen, or verify the credentials of every user. While we verify recruiters before they can browse athletes, we cannot guarantee any user's identity, intentions, or truthfulness. You interact with other users at your own risk.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
SPOTLIGHT RECRUIT LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, including (but not limited to) damages for loss of profits, goodwill, use, data, opportunity, or other intangible losses, even if we were advised of the possibility of such damages.
In no event will our total cumulative liability to you for all claims arising from or relating to your use of the Service exceed the greater of:
- The amount you paid us in the 12 months preceding the claim (which is $0 in v1, as the Service is free), or
- One hundred US dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
15. Indemnification
You agree to indemnify, defend, and hold harmless Spotlight Recruit LLC and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any third party's rights
- Content you upload or share through the Service
- Your interaction with other users
16. Dispute resolution and arbitration
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
Informal resolution
Before filing any formal claim, you agree to first contact us at legal@spotlightrecruit.com to attempt to resolve the dispute informally. We will respond within 30 days.
Binding arbitration
If we cannot resolve the dispute informally, any claim, dispute, or controversy arising out of or relating to these Terms or your use of the Service will be resolved exclusively through binding arbitration, not in court.
- Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
- Arbitration will take place in Manatee County, Florida, or by telephone/video at our discretion
- The arbitrator will apply Florida law
- The arbitrator's decision is final and binding
Class action waiver
YOU AGREE THAT ANY CLAIM MUST BE BROUGHT INDIVIDUALLY, NOT AS A CLASS ACTION OR REPRESENTATIVE PROCEEDING. You waive the right to participate in any class action, collective action, or representative lawsuit against Spotlight Recruit LLC.
Exceptions to arbitration
The following may be brought in court:
- Claims for injunctive relief related to intellectual property infringement (by either party)
- Small claims court matters within that court's jurisdiction
Right to opt out
You may opt out of the arbitration agreement by sending a written notice to legal@spotlightrecruit.com within 30 days of first accepting these Terms. Include your name, the email associated with your account, and a statement that you wish to opt out.
17. Governing law and jurisdiction
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles.
Except for claims subject to arbitration, you agree that any legal action arising from these Terms or your use of the Service will be brought exclusively in the state or federal courts located in Manatee County, Florida, and you submit to the personal jurisdiction of those courts.
18. Changes to these Terms
We may update these Terms from time to time. When we do, we will:
- Update the "Last updated" date at the top
- For material changes, give you reasonable notice (such as through an in-app notice or email)
Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.
19. General provisions
- Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Spotlight Recruit LLC regarding the Service.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
- No waiver. Our failure to enforce any provision is not a waiver of that provision.
- Assignment. You may not assign these Terms. We may assign them to any successor or affiliate.
- Headings. Section headings are for convenience only and do not affect interpretation.
- Notice. We may give you notice through in-app messages, email to your registered email address, or postings on spotlightrecruit.com. You may give us notice at legal@spotlightrecruit.com.
